5 time DUIs get sentences
Two men were sentenced last week for their fifth drunken driving conviction.
The cases are not related except that they both were heard by Butler County Judge William Shaffer on Thursday.
Mark L. Hoover, 43, of West Sunbury was arrested Sept. 11, 2010, after a single vehicle accident on Euclid Road in Clay Township.
Court records indicate Hoover’s blood alcohol level was 0.218 percent. A level of 0.08 percent is considered intoxicated under state law.
Hoover, who pleaded guilty to drunken driving and driving with a suspended license, was sentenced to 3 to 6 months in the county prison. He also must pay $1,200 in fines, log 60 hours of community service and attend a victim impact panel.
According to court officials, this was Hoover’s first drunken driving conviction in 10 years, but his fifth overall. Court officials weigh only the convictions within the past decade when setting a sentence.
John C. Rodgers, 30, of Valencia was arrested Oct. 19, 2010, after his vehicle left the road and struck a house on Old Glade Mill Road in Middlesex Township.
Rodgers, who pleaded guilty to drunken driving, was sentenced to five years in the county’s Intermediate Punishment Program.
As part of his punishment, Rodgers will spend the first month in jail, then 90 days on house arrest with electronic monitoring. The remainder of the program will be on probation.
Rodgers also must log 60 hours of community service and attend a victim impact panel.
Court records indicate this is Rodgers third drunken driving conviction in the past decade.
