Judge throws out guilty verdict against doctor
Minutes after a Butler County jury found Dr. David Evanko guilty of sexual abuse Friday evening, the judge set aside the verdict and granted the doctor a new trial.
After four days of testimony and judicial bickering, Clarion County Senior Judge Charles Alexander said he was awarding a new trial to Evanko because of prosecutorial misconduct.
"In my 52 years in this business, I have never seen such behavior as what went on this week from the Commonwealth (attorneys)," said Alexander, who tried the case because of Evanko's ties to Butler County jurists through his work with Children and Youth Services.
Evanko had been charged with two counts each of institutional sexual assault, indecent assault, unlawful contact with a minor, and child endangerment.
These charges stem from the accusations of two former students of Summit Academy in Summit Township, which is a court-ordered disciplinary school for juvenile offenders.
Evanko's attorney said he would seek to dismiss the new charges that are to be filed.
