City man gets prison sentence for his 5th DUI conviction

Officials: He was still on probation

A city man was sentenced Wednesday to serve state prison time for his fifth drunken driving conviction.

According to court officials, 57-year-old David A. Nussbaumer still was on probation from his fourth DUI conviction when he was arrested, again, April 13.

On that date, Nussbaumer reportedly did not stop after his van hit a car that was occupied but parked, according to court records.

The car’s driver followed Nussbaumer’s van until city police caught up with them near Nussbaumer’s home on First Street, according to court records.

Court records say a test later revealed that Nussbaumer’s blood alcohol level was 0.19 percent. A person with a level of 0.08 percent is considered intoxicated under state law.

Nussbaumer pleaded guilty to drunken driving and driving with a suspended license.

Butler County Judge Timothy McCune sentenced Nussbaumer to serve 15 to 60 months in prison on that case.

However, the judge said if Nussbaumer completes a special program in state prison, his prison term could be reduced to 11 months.

Court officials said the conviction was Nussbaumer’s’ third DUI conviction in the past 10 years and fifth throughout his lifetime.

In Pennsylvania, only DUI convictions within the past 10 years are factored into sentencing.

McCune on Wednesday also ordered Nussbaumer to spend another 1 to 3 years in state prison on the 2008 case because the new DUI conviction violates the probation in that older case. Court records say Nussbaumer’s other DUI convictions were in 2004, 2000 and 1997. In addition to the prison time, the judge ordered Nussbaumer to pay $3,500 in fines.
