Man guilty of ATV charges

Sentencing to be in August

A 19-year-old Chicora man was found guilty of two summary charges in relation to an all-terrain vehicle police chase during a non-jury trial in Butler County Court on Monday.

William J. Simmons III, was found guilty of summary driving an ATV on a street and unsafe driving on an ATV by county Judge William Shaffer. He is scheduled for sentencing Aug. 24.

Simmons was also charged with misdemeanor fleeing or attempting to elude police, but that charge had previously been withdrawn by the commonwealth.

Former Pennsylvania State Police trooper Robert Downs, now retired, testified that at 5:40 p.m. Aug. 21, 2016, he was patrolling along Route 268, when he saw two ATVs heading in the opposite direction. He said the vehicles were not equipped to be on the road, and turned around and attempted to initiate a traffic stop at the intersection with Fairmont Road.

Downs said the vehicles continued along Route 268 for five to seven miles through Chicora before pulling onto a gated dirt road and into the woods.

Downs said he recognized the lead ATV as a Honda 400EX, as he owned one of the same make, but never got a clear view of the drivers because both were wearing helmets. The ATVs, described as a yellow one in the lead with a slender white male driver, and an orange one following, with a heavier set male driver.

Dashcam video from the trooper's vehicle was played in court, showing the ATVs passing several vehicles during the chase, making no effort to stop.

Police used surveillance video and social media to identify the suspects — Simmons and a juvenile. Simmons' social media account showed a photograph of two ATVs matching the description, and when police questioned him, he showed officers the vehicle, as well as the helmet worn by the driver, Downs testified. Downs said Simmons also matched the body type of the drivers.

The prosecution was represented by Assistant District Attorney Benjamin Simon.
