Butler man arrested on gun charge in Allegheny County

Birch Foley was charged Friday with possession of a firearm in a court facility.

A Butler man was arrested Friday on gun possession charges for carrying a concealed handgun when he attempted to enter the Allegheny County Courthouse.

Birch Foley, 40, was charged with possession of a firearm in a court facility and disorderly conduct by Allegheny County Sheriff's Office after he allegedly tried to pass through a metal detector with a loaded .45-caliber handgun concealed under a pant leg, the sheriff's office said in a news release.

Foley was scheduled to appear before Common Pleas Court Judge Thomas Flaherty regarding an incident in which he was charged with retail theft and possession of a prohibited offensive weapon, according to the sheriff's office.

After multiple attempts to pass through the magnetometer resulted in alerts, Foley denied having any metal objects, the sheriff's office said.

Guards had Foley step aside where they scanned him with a hand-held metal detector, which alerted guards to something in or near Foley's shoe, the sheriff's office said.

After lifting Foley's pant leg and allegedly finding the gun, guards seized the gun and confined Foley, the sheriff's office said.

Deputies responded and took Foley into custody. He had a state license to carry firearms issued in Butler County.

Flaherty was notified about the incident and revoked Foley's bond. Deputies placed him in the Allegheny County Jail.
