BUTLER TWP — A Butler veteran will receive psychiatrict treatment as part of his bond after he waived his right to a preliminary hearing Thursday.

Breven Smith, 33, of Butler Township, appeared in court virtually for a preliminary hearing, related to his alleged firing of an AR-15-style rifle inside his home in the Lyndora area.

He has been charged with misdemeanors of reckless endangerment and disorderly conduct as well as a summary firearms violation.

Smith has remained in Butler County Prison after District Judge Kevin O'Donnell denied bond following the arraignment Aug. 18.

While Smith waived his right to a preliminary hearing, the matter of his bond was an area of discussion between Assistant District Attorney David Beichner and Smith's attorney, Patrick Casey.

The two sides found a solution by adding a conditional bond requiring psychiatric treatment.

Being a military veteran, Smith will be transferred to the Pittsburgh VA for psychiatrict treatment.

“If he doesn't complete the program, he will immediately be detained,” Beichner said. “If he completes the program, he'll be placed on house arrest.”

Beichner noted Smith may also have to complete an additional step in his treatment, based on the results of a 2017 case.

In 2017, Smith pleaded guilty to resisting arrest, a second-degree misdemeanor.

Still, if Smith completes all the necessary treatment, he can be released on house arrest. Following the shooting, neighbors express concerns about the shooting and the safety of the neighborhood.

Casey said the bond meets the recommendations by multiple involved entities.

“This was the appropriate action as determined by his VA health team and adult probation, that he receive psychiatric care at the Pittsburgh VA in a secure psychiatric facility,” Casey said.

Smith is expected to appear next for formal arraignment Sept. 19 in the Butler County Court of Common Pleas.
