New York man sees charges reduced in case of burning vehicle
A man from New York state, accused of setting his car on fire in a Butler County field, had all of his felonies reduced to lesser offenses Wednesday.
Steven D. Gierlach, 42, of Ithaca, N.Y., waived his right to a preliminary hearing Wednesday before District Judge Joseph Nash.
Before the hearing, state police agreed to reduce Gierlach’s most serious charges. One felony count of dangerous burning and criminal mischief as well as misdemeanor defiant trespassing were reduced to summary offenses.
Also, one felony count of agricultural vandalism was reduced to a misdemeanor.
Following Wednesday’s changes, Gierlach no longer faces any felony charges that were filed after police accused Gierlach of burning his vehicle in a crop field in Prospect.
The property owner was in court Wednesday and was consulted by state police about the reduction of the charges. An assistant district attorney was also involved in the conversation as well as defense attorney Al Lindsay.
“We think that it was an appropriate resolution today,” said Lindsay afterward.
According to charging documents, Gierlach told officers he set fire to his vehicle because he was “being chased by the FBI,” and he also admitted to being under the influence of methamphetamine.
Gierlach has other charges that were untouched Wednesday, including misdemeanor DUI and disorderly conduct.
Gierlach will next appear for formal arraignment in Butler County Common Pleas Court. A date was not immediately available Wednesday.
