Butler man arrested after incident late Sunday night
A Sunday night disturbance at Sheetz in Butler Township led to felony charges against a Butler man, who police claim fought and resisted them.
“I told him several times to stop resisting arrest,” said the investigating officer in the affidavit. “He kept fighting.”
Following the incident, Butler Township police filed charges against Zachary R. Fair, 35, including two felony counts of aggravated assault as well as misdemeanor counts of resisting arrest, driving under the influence and marijuana possession.
Fair was arraigned Monday morning by District Judge Kevin O’Donnell, then placed in Butler County Prison in lieu of $15,000 bail.
According to charging documents, police arrived at the Sheetz parking lot around 9:45 p.m., and they found Fair passed out in a vehicle. Police said after some difficulty, Fair awoke confused and smelling of alcohol.
Police said when they asked him to step out of the vehicle, he refused and began making repeated calls to his father.
When Fair finally exited the vehicle, police said, he placed his hand in his pocket and refused to remove it. A struggle ensued, during which Fair was taken to the ground and police discharged a Taser.
“I stated to the male that I was trying not to hurt him and to stop resisting,” police said.
The most serious charges stem from injuries to two officers during the altercation. According to the itemized charge, one officer suffered a strained neck and scrapes, while the second officer suffered a sore knuckle.
Police said a later review of Fair’s driving credentials showed his license was suspended, the vehicle’s registration had expired, and proof of insurance was unable to be shown.
Fair is scheduled to appear Thursday, Sept. 22, for a preliminary hearing before O’Donnell.
