Charges dismissed against man accused of theft more than 7 years ago
CRANBERRY TWP — Theft charges were dismissed Friday during the preliminary hearing of a man who was previously accused of stealing thousands from Lowe’s eight years ago.
Timothy P. Brown Jr., 42, of Rochester, was charged on Oct. 6, 2015, with felonies of conspiracy, theft and device fraud for multiple incidents in 2014 and 2015.
Proceedings were held in the Cranberry magistrate’s office before District Judge Joseph Nash, who was filling in for District Judge Kevin Flaherty.
According to Michael J. Carland, defense attorney, Brown has spent the more than seven years in federal prison for a previous crime, which is why no action was taken on his case in Butler County. He was sentenced to serve a 10 years for the previous crime in Beaver County.
Dave Beichner, assistant district attorney, appealed to Nash that for the payment of $4,200 in restitution, charges against Brown would be dismissed.
Brown initially was charged alongside Daniel Nolder, 26, of New Brighton; Sarah Lloyd, 26, of Cranberry Township; Austin Hunter, 26, of Cranberry Township; and David Anderson, Jr., 34, of New Brighton, in connection to an alleged organized retail theft ring, according to court documents.
