Drug charges held in 3 cases against Butler woman Monday
Drug charges from three cases filed against a Butler woman were held for court following preliminary hearings Monday, June 3 in Butler.
Marki M. Seezox, 34, of Butler, appeared before District Judge William Fullerton represented by attorney Stanley Booker in all of the cases, two of which are connected to an incident March 13 and one of which pertains to a search conducted at a West Cunningham Street apartment in April.
In the March 13 cases, police said 6,866 stamp bags, or about 137 bricks, of suspected fentanyl were found, along with 217 grams of powder cocaine 95 grams of crack cocaine and $28,888.
Ryan Doctor, an officer with Butler City police, was called as a witness in the first two cases.
He said several officers, including himself, were conducting surveillance for the county drug task force when he was informed Seezox and co-defendants Amy Calvert, 43, and James Matuke, 35, both of Butler, were seen exiting a residence on Oak Street and entering a black GMC Hummer on that date.
Tim Fennell, chief county detective, later said he saw Seezox enter the vehicle’s front passenger seat before it departed.
According to Doctor, the Hummer was seen traveling in the area, picking up another man, and eventually dropping him off at an East Pearl Street address.
The man’s girlfriend was later found in possession of three stamp bags of suspected fentanyl, Doctor said, and the man told them he had given $60 to Seezox for them.
Doctor later specified the man informed him he had paid Seezox for the drugs, but received the drugs from Matuke.
Doctor said they conducted a traffic stop on the Hummer and found Seezox in possession of $60 and empty stamp bags.
On cross-examination, Doctor said he did not see the alleged transaction as he was passing in a vehicle, but he did see the man go toward the passenger side of the vehicle.
Fennell said they later searched the Oak Street address where Matuke and Seezox were living, and found “excessive amounts of narcotics” in a bedroom.
Doctor indicated that when he arrived at the residence for the search, it appeared someone was in the process of moving out. Booker, on cross-examination, later said Seezox was attempting to move from the residence.
During argument, Booker said the first case against his client was hearsay, and the commonwealth did not meet its burden of proof.
“This entire case is based on what someone said, who did not testify,” he said.
Assistant district attorney Terri Schultz responded that at the very least, Seezox could be charged with conspiracy based on the evidence.
Fullerton held the charges over for court.
In the third case, Seezox was charged with two felony counts of possession with intent to deliver, a felony count of criminal conspiracy, two misdemeanor counts of possession of a controlled substance, and a misdemeanor count of possession of drug paraphernalia after a search warrant was served on a West Cunningham Street apartment.
Doctor testified that Seezox was in the apartment, along with co-defendants Matuke and Kelly L. Wilson, 55, of Butler, and three others, when the search was conducted.
Seezox was found in possession of $768, according to Doctor. The search yielded 37.5 grams of crack cocaine, 364 full stamp bags of suspected fentanyl, about 27.5 grams of an unknown white powder, about 2.7 grams of an unknown purple rock-like substance, four digital scales, Suboxone strips and clear plastic baggies.
Doctor added that documents identifying Matuke and Seezox were found in the apartment.
Booker argued there was no evidence suggesting his client was connected to the drugs found in the West Cunningham Street search.
“There is zero evidence at all that my client knew there were drugs in that room, that she possessed drugs,” he said.
Fullerton held the charges over for court.
Calvert was scheduled for a preliminary hearing Monday on charges from the March 13 incident, but it was continued.
Matuke’s charges in these matters were held for court after a preliminary hearing May 6.
