Charges refiled against Beaver County man accused of sexual assault
Charges were refiled Thursday, June 13, against a Beaver County man accused of sexually assaulting a girl in Callery, the day after those same charges were dismissed at his preliminary hearing.
Milton A. Elder, 49, was once again charged with felonies indecent assault, corruption of minors and child endangerment related to a ChildLine report that was filed in November.
According to charging documents, the report indicated Elder touched the girl inappropriately about 10 times, starting when she was age 8 or 9. The girl is now 13 years old and testified in court Wednesday.
A Children and Youth Services representative from Beaver County interviewed the girl in December. Police said she disclosed Elder touched her inappropriately several times at a home in Callery and at a home in Beaver County.
Though the girl identified Elder several times by name Wednesday, defense attorney Marc Taiani said his client was not directly pointed out during questioning.
Taiani moved for a dismissal of the charges, saying Elder was not identified specifically as being in the courtroom and seated next to counsel. Because of this, he said the commonwealth had not met their burden.
The charges were dismissed by District Judge Amy Marcinkiewicz, who encouraged the investigating trooper to refile them.
Elder’s next preliminary hearing has not yet been scheduled.
