The state Department of Environmental Protection is seeking a court order to get the owner of a mobile home park in Jackson and Lancaster townships to file a water supply permit.

The DEP filed the petition Monday in Common Pleas Court in an effort to get Jones Estates Pine Valley PA of North Carolina to file a public water supply permit for nine wells used to provide water to the Pine Valley Estates mobile home park.

According to the petition, the DEP and Pine Valley entered into a consent order and agreement in September 2022 that called for Pine Valley to file a public water supply permit application that modifies an existing permit by including a schematic of the treatment system, and includes proposed modifications to its water treatment plant that ensures minimum water levels in each storage tank.

Pine Valley did not submit the application by the Nov. 1, 2022, deadline in the consent order, and the DEP sent the company a breach of order notice on Nov. 8, 2022, after it did not receive an “administratively complete” application, according to the petition.

Since then, the DEP has worked with Pine Valley to submit the application. Pine Valley submitted an application in March this year, but it contained “significant technical deficiencies,” prompting the DEP to send a letter outlining the deficiencies, according to the petition.

The DEP said it did not receive any of the items identified in the letter and sent another letter in May before meeting with Pine Valley officials in June. Pine Valley requested a 30-day extension but has not submitted an application that address the deficiencies that were identified in March, according to the petition.

To comply, Pine Valley has to update the application to identify iron and manganese treatment methods and determine low water level alarm and shut-off points in the storage tanks, according to the petition.

The DEP has not received any formal complaints regarding the water quality and the water system remains active and safe for customers to drink, a DEP spokesman said Tuesday.

Pine Valley Estates could not be reached for comment.
