Butler man charged following gun incident

A Butler man was arrested on weapons charges following the investigation into an apparent bullet hole found Tuesday, Sept. 24, in his neighbor’s house in the city.

Joseph M. Musick, 57, was charged with prohibited possession of a firearm, a felony, and misdemeanor counts of terroristic threats, possession of an offensive weapon and simple assault, and placed in the county prison in lieu of $50,000 bond.

Butler police were dispatched to a home in the 200 block of Morton Avenue for a report of a gunshot into a house where Robert Huey and his girlfriend live, and found a hole through an upstairs window and an interior wall that was consistent with damage caused by a bullet, according to an affidavit.

Huey told police that Musick, his neighbor, pointed an older style firearm at him during a confrontation that took place about an hour and half before he found the bullet hole, according to the affidavit. Huey described the gun as a “Pirates of the Caribbean gun” with a rounded brown wood handle and a long barrel, police said.

Police then went to Musick’s house and detained him. His wife told officers that Musick had a “broken gun and he took it out,” and then made a waving motion with her hand to describe what he did with the gun, according to the affidavit.

She then showed police the gun, which was disassembled and did not match the description given by Huey, according to the affidavit. Musick told police there was confrontation between him and Huey and the gun his wife showed officers was the gun he had during the confrontation, but he denied shooting the house.

While police were serving a search warrant at Musick’s house later, his wife led officers to the attic where a modified bolt-action rifle with a wood stock and short barrel, a .44-caliber black powder revolver and two boxes of ammunition were found, according to the affidavit.

Later at the police station, Huey identified the rifle as the gun Musick pointed at him, according to the affidavit.
