Man serving federal drug sentence given state prison time for DUIs

A Bruin man serving a 3-year sentence in a federal drug case was sentenced Thursday in Common Pleas Court to serve 2 to 14 years in state prison after he pleaded guilty to his fourth and fifth driving under the influence charges.

Gilbert E. Smith, 45, was sentenced in September to serve 3 years in federal prison followed by 4 years of probation after he pleaded guilty to a felony conspiracy to possess with intent to deliver fentanyl charge that was filed against him in August 2023 following a four-month wiretap investigation into drug trafficking, unlawful firearms possession, and gang activity in Pittsburgh’s North Side neighborhoods. Federal authorities charged 16 other people as a result of the investigation.

On Thursday, Smith pleaded guilty remotely from the county prison to his fourth and fifth DUI charges.

Judge Timothy McCune sentenced Smith to serve 12 to 48 months in state prison for the fourth DUI, consecutively serve another 12 to 48 months in prison for his fifth DUI, pay $5,000 in fines, and complete 80 hours of community service and litter pickup. Both charges are felonies. Smith was given credit for already having served 537 days in prison.

State police filed the DUI charges. The fourth DUI charge was filed for driving under the influence of a controlled substance following a Jan. 24, 2022, incident in Bruin. The fifth DUI charge came following a May 14, 2023, incident in Fairview.

The district attorney’s office agreed not to prosecute Smith on a possession of drug paraphernalia charge filed by Butler Township police filed in March 2023 and eight drug charges including two felony counts of possession with intent to deliver filed by state police in March 2023.
