Lyndora sex offender sentenced for soliciting child sex
A Lyndora man, found to be a sexually violent predator in 2013, was sentenced Thursday, Dec. 5, to serve 15 to 30 years in prison after pleading guilty to criminal solicitation to commit rape of a child.
Robert. E. Schmidt, 40, was ordered to serve his sentence in state prison followed by three years of probation.
Butler city police charged Schmidt in May saying he requested pictures of a 2-year-old child from her mother for sexual gratification and later asked to have sex with the toddler.
The child’s mother and Schmidt were dating when she provided photos of her child as he requested, knowing his intentions were inappropriate, according to an affidavit.
Assistant district attorney Ben Simon said Thursday that Schmidt was previously found to be a sexually violent predator, and that assessment was reaffirmed in a Nov. 15 evaluation.
Schmidt was found to be a sexually violent predator under Megan’s Law in November 2013 after pleaded guilty to a charge of involuntary deviate sexual intercourse with a child and was sentenced to serve 6 to 15 years in prison followed by three years of probation.
In his sentence order, Judge Timothy McCune said the law’s requirements apply to Schmidt.
According to the Megan’s Law portal, Schmidt is designated as a sexually violent predator and is required to register for life due to his previous offense.
