Police: Harmony man charged following deceptive Lego sale

A Harmony man has been charged for selling Legos under false pretenses.

Jacob Ruth, 24, of Harmony, is facing three misdemeanor charges of theft by deception following an incident in September.

According to an affidavit of probable cause, Kurt Larson contacted police the day after Christmas alleging he had purchased two Harry Potter Lego sets from Ruth on Sept. 12, 2024, with the assurance they were new and unopened. Larson stated the purchase was made with the intention of using the sets as presents for his granddaughter, so he had not opened them prior to Christmas morning.

According to the affidavit, when the boxes were opened, Larson allegedly found them to have been resealed with Scotch tape and glue. Additionally, Larson said the boxes contained Star Wars Legos and not Harry Potter ones. Additionally, he said part of one set had been partially assembled already.

According to police, Larson contacted the manufacturer and was told they do not seal boxes that way. Larson then contacted Ruth to inform him of his discovery.

The affidavit showed Ruth allegedly responded by saying in Pennsylvania a sale is complete and final after an exchange of money and that he does not do returns. Ruth allegedly also told Larson that to pursue the matter in civil court would cost more than the value of the Legos and refused to rectify the situation, police said.

A preliminary hearing for Ruth is scheduled Feb. 19 before District Judge Amy Marcinkiewicz.
