Ellwood City woman charged in Muddy Creek homicide; boyfriend sought
An Ellwood City woman has been charged with homicide in Butler County, but charging documents indicate her boyfriend may have pulled the trigger.
State police filed charges during the weekend against Nicole L. Schwartz, 36, who was arraigned Saturday morning by District Judge Lewis Stoughton on two counts of homicide in relation to the death of Frederick Orr, 32, of Columbus, who was shot in Muddy Creek Township.
Stoughton denied Schwartz bond, and she is now in Butler County Prison.
According to court documents, a man known as “K,” Schwartz’s boyfriend, also is believed to be connected to the case and may have been the one who pulled the trigger.
Charges have yet to be filed against “K,” and it is unclear whether or not he has been arrested or questioned regarding the case.
As of noon Tuesday, state police could not provide additional information on the possible second suspect.
According to charging documents, Schwartz drove her Kia SUV to the Butler County Prison on June 10 to pick up Orr, who she identified as a former boyfriend.
Police said once Schwartz was in the vehicle, she drove north to Kelly Road, a stretch of road that spans a little less than 2 miles between East Portersville and Yellow Creek roads.
“Schwartz related she provided a gun to her current boyfriend, ‘K’,” police said. “‘K’ was in the rear cargo area of her Kia SUV and was covered in a blanket.”
Police said Schwartz told the officer she stopped her vehicle on Kelly Road, at the site where Orr’s body was found, and “K” emerged from the cargo area. She told police “K” forced Orr from the vehicle at gunpoint.
“Schwartz related ‘K’ then shot the victim multiple times,” police said.
Police said Schwartz and “K” returned to her home, parked the SUV in the garage and they washed their clothes.
Orr’s body was found around 3:30 a.m. June 11 at the site of his death, according to police.
Butler County Coroner William Young III later confirmed that Orr died from a fatal gunshot wound to the head.
Police said they saw the body had multiple gunshot wounds, as well as other debris on and near it.
“Two bullet slugs, two spent casings (and) a piece of glass consistent with a passenger-vehicle side window were observed in the area,” said police in the affidavit.
Police said they matched the mirror found near the body to Schwartz’s SUV. The same day Orr’s body was found, police received a warrant to search her home on Bell Avenue in Ellwood City and the SUV was in the garage.
“Blood was recovered from the vehicle, and vehicle parts were missing from the vehicle that were consistent with parts recovered at the crime scene,” police said.
Police said they interviewed Schwartz on Friday at the Butler barracks, and she told them that she had been seeing Orr until he went to jail.
On May 31, Orr was arrested during a traffic stop on Route 422 in Franklin Township after police said they found marijuana and crack in the vehicle. He subsequently was charged with felony drug sales and misdemeanor counts of drug and paraphernalia possession.
Orr was placed in Butler County Prison in lieu of $50,000 until he posted June 10, and he was expected to appear for a preliminary hearing June 15.
Schwartz told police that while Orr was in jail, she had spent about $3,000 of his money. She said she also began seeing “K.”
“Schwartz related that on June 10, the victim was released from jail and contacted her about his cash,” police said. “Schwartz arranged to pick him up in Butler City.”
A preliminary hearing for Schwartz is scheduled July 6 before District Judge Joseph Nash.
