A Butler man charged in fight that resulted in broken ankle
A Butler man is facing several charges after police said he assaulted another man, who sustained a broken ankle, on Saturday, Sept. 28, at the Butler Fall Festival.
City police charged Nathan A. Heigley, 46, with felony counts of aggravated assault and endangering the welfare of children, and misdemeanors resisting arrest, disorderly conduct and DUI. He was placed in the county jail in lieu of $100,000 bond.
Police were dispatched to North Main and Brady streets for a report of a man who sustained a broken ankle during an assault by a man who had a small child with him, according to an affidavit.
The man told police he didn’t know Heigley, but had been interacting with him for several hours during the festival, and said both had been drinking. He said a fight broke out during a discussion and he broke his ankle, according to the affidavit. Police noted his broken ankle had begun to protrude through his skin.
A witness told police the man tried to de-escalate the situation, began to back up with his hands down and didn’t raise a hand toward Heigley, according to the affidavit.
Police said they located Heigley at a home on Oak Street, where a woman told officers she was told Heigley struck vehicles parked on the street. Police said they found his car with front and side damage, according to an affidavit.
Heigley was taken to the ground and handcuffed after he tried to prevent officers from taking him into custody. Police said he emitted a strong odor of alcohol, could not walk without assistance and was not able to perform a field sobriety test, according to the complaint. Police added that two damaged vehicles were located on Oak Street.
