Man acquitted of shooting at bar

A Chicora man has been acquitted of allegations he shot at a local bar.

Gary Ellenberger, 43, of 362 Cherry Road had been thrown out of the Last Laugh Bar &Grill in Chicora on Dec. 19, just prior to someone shooting at the bar's door, according to court documents.

Shotgun pellets hit the bar door and a truck owned by David Collier, one of the bar's two owners.

Court documents indicate more than $2,500 worth of damage was done to the door and truck, a 2003 Chevrolet Silverado.

The bar's other owner, Kathy Lowers, was standing between 6 and 8 feet from the door when it was hit, but was not injured, according to court documents.

Both Collier and Lowers had asked Ellenberger to leave after he became loud and unsuccessfully attempted to entice other patrons into arm wrestling, according to court documents.

One patron claimed he heard Ellenberger say he was going to get a gun as he left the bar, according to court documents.

A Butler County jury heard the evidence on Tuesday and found Ellenberger not guilty of all charges: simple assault, reckless endangerment, criminal mischief and a felony crime called discharging a firearm into an occupied structure.

Butler County Judge George Hancher, who presided over the trial, separately acquitted Ellenberger of a summary charge of harassment.

Ellenberger's defense attorney, David DeFazio, said he "believed in my client's innocence from the beginning ... I'm delighted justice has been done."
