Man charged with same crime twice in 2 months
State police have charged a Butler man three times in two months, twice for the same crime.
State Police in Kittanning charged Robert Anthony Hornbuckle II, 35, with felony possession with intent to deliver a controlled substance and four misdemeanor charges for possession of a controlled substance, marijuana and drug paraphernalia during a Dec. 23 traffic stop in Butler.
He was charged with the same felony, as well as three misdemeanors, in a Dec. 12 traffic stop in Butler Township.
Police said Hornbuckle admitted to possessing marijuana at the Dec. 23 traffic stop, and officers witnessed him continuously attempt to put his hands inside his coat pockets. Police found plastic bags containing suspected crack cocaine inside his right jacket and jean pockets, and a plastic bag of marijuana in his left coat pocket, according to the criminal complaint. Police said Hornbuckle and the female driver both quickly opened their doors upon being stopped.
Police said one of the plastic bags of suspected crack cocaine contained 22 individually wrapped bags of the suspected substance packaged for sale.
Hornbuckle’s preliminary hearing for the Dec. 23 case has not been scheduled, but his hearing for the Dec. 12 traffic stop is scheduled for 9:30 a.m. Thursday, Jan. 30, before District Judge Kevin O’Donnell.
In the Dec. 12 stop, police immediately detected an odor of burned marijuana in the vehicle and observed a partially smoked marijuana cigarette in plain view in the ashtray in the cup holder, according to the complaint. Police found a Ziploc bag and plastic bag containing 25 grams of suspected heroin in his right jacket pocket and a plastic bag containing marijuana in his pants. Another plastic bag of marijuana was found in the vehicle.
Hornbuckle was stopped again Dec. 30 at a Super 8 and charged with misdemeanor marijuana possession.
His preliminary hearing in that case is scheduled for 9:30 a.m. Feb. 20 before District Judge Kevin O’Donnell.
