Boyers man found guilty in indecent assault
Family members of women who accused a Boyers man of indecent assault, corruption of minors and endangering the welfare of children cried when he was found guilty Friday, March 21.
An 11-person jury of eight women and three men deliberated for about two hours and 50 minutes before finding Shawn Berkstresser, 54, guilty in two cases involving inappropriate contact with four people between 2017 and 2022.
State police filed charges against Berkstresser, alleging he had inappropriate contact with the women when three were minors and one was 18 years old. One case involved three alleged victims who testified Monday, and the second case involved one alleged victim who testified Tuesday.
He was charged with one felony count of indecent assault, two felony counts each of corruption of minors and endangering the welfare of children, and five misdemeanor counts of indecent assault.
“Justice was served,” said Diane Dunbar, a relative of one of the women involved in the case. “We are all so very happy.”
Butler County Common Pleas Judge Joseph Kubit revoked bond for Berkstresser after he was found guilty. Defense attorney Nina Martinelli argued the case has been pending since 2022, and Berkstresser had never missed a court date and was not a flight risk.
Kubit said he would not revoke bond due to the nature of the crime. Berkstresser’s sentencing has not yet been scheduled.
The women who accused Berkstresser said the touching took place almost daily for some of them. They said he touched their breasts, vaginas and buttocks.
The women said Berkstresser would sometimes ask if his actions would bother them, and they told him it either didn’t bother them or didn’t respond. They said they went to police after eventually feeling the touching was not normal.
Berkstresser testified Wednesday and Thursday that he did not touch the alleged victims inappropriately, and they regularly came to him with medical issues like sore muscles and irritated skin he would rub. He said talk about sex and body parts with the women was common.
